Legal Guarantee of Conformity
For goods purchased from Music Max d.o.o., consumers are entitled to the statutory rights arising from the legal guarantee of conformity in accordance with applicable legislation.
The seller is liable for any lack of conformity that existed at the time of delivery and becomes apparent within the period prescribed by applicable law.
The goods must conform to the contractual description, type, quantity and quality and must have the characteristics, functionality, compatibility and other features agreed in the sales contract. The goods must also meet the objective requirements for conformity laid down by applicable legislation.
Consumer rights in the event of lack of conformity
If the goods do not conform to the sales contract, the consumer may exercise the rights provided by the applicable legislation under the legal guarantee of conformity.
The consumer may first request the goods to be brought into conformity free of charge, normally by repair or replacement. If conformity is not restored within the period prescribed by law, or if other statutory conditions are met, the consumer may also be entitled to a reduction in the purchase price or to terminate the sales contract and receive a refund.
How to exercise your rights in the event of lack of conformity
If you believe that the goods do not conform to the sales contract, please notify us and provide a description of the lack of conformity. You may submit your claim to Music Max d.o.o. in accordance with the procedure set out in our Terms and Conditions or on our Product Returns page.
After receiving your claim, we will process it in accordance with applicable legislation and inform you about the further procedure.
Commercial Guarantee or Voluntary Guarantee
A commercial guarantee, also referred to as a voluntary guarantee, is an additional obligation undertaken by the manufacturer or seller in addition to the legal guarantee of conformity.
If a commercial guarantee is provided for a particular product by the manufacturer or seller, its duration, scope, conditions and procedure for exercising the guarantee are stated on the relevant product page and/or in the accompanying guarantee documentation.
A commercial guarantee does not limit the consumer's statutory rights under the legal guarantee of conformity.
Manufacturer's Guarantee of Durability
For certain products, the manufacturer may provide, in addition to the legal guarantee of conformity, a specific commercial guarantee of durability. Such a guarantee is voluntary and constitutes an additional commitment by the manufacturer regarding the durability of the product for a specified period.
If a manufacturer provides a free commercial guarantee of durability for a particular product, covering the entire product and lasting for more than two years, information about its existence and duration will be displayed for that product in accordance with the applicable European Union rules.
Legal Guarantee and Commercial Guarantee are Different
The legal guarantee of conformity and a commercial guarantee are two different legal concepts.
- Legal guarantee of conformity arises directly from applicable legislation and must be provided by the seller to the extent required by law.
- Commercial or voluntary guarantee is an additional commitment by the manufacturer or seller under the terms and conditions specified in the guarantee.
Exercising rights under a commercial guarantee therefore does not exclude or limit the consumer's statutory rights under the legal guarantee of conformity.
